The lawsuit challenging Prop. 8 under the U.S. Constitution, filed by Theodore Olson and David Boies last May, will be heard in federal court in San Francisco on January 11. The lawsuit challenges the constitutionality of Prop. 8 on five counts:

(1) that it violates the "due process" clause of the constitution by impinging on fundamental liberties [the SCOTUS previously found in Loving v. Virginia that marriage is a fundamental liberty];

(2) that it violates the "equal protection” clause of the Fourteenth Amendment;

(3) that it singles out gays and lesbians for a disfavored legal status [an argument used in Romer v. Evans, when the U.S. Supreme Court overturned Colorado’s Amendment 2], thereby creating a category of “second-class citizens";

(4) that it discriminates on the basis of gender; and

(5) that it discriminates on the basis of sexual orientation.
Now, this case ought to be interesting for a number of reasons. First, it’s bound to go to the Supreme Court, which isn’t very liberal, thanks to President George W. Bush’s appointments of Justices Alito and Roberts.

Second, if the Supreme Court overturns Prop. 8, does that overturn all the anti-marriage laws and constitutional amendments in the nation, as Loving v. Virginia effectively did for anti-miscegenation laws?

But right now, the big issue is whether or not the trial will be televised.U.S. District Court Judge Vaughn Walker has been considering whether or not to televise the proceedings, and he asked for public comment. There have been so many responses, both pro and con, that he’ll be holding a hearing on the matter tomorrow.

Frankly, I think it’s a no-brainer. This is a case about fundamental human rights—it’s a chance for both sides to make their legal arguments about what constitutes a right, a liberty and a privilege, and about what makes us equal before the law. If that isn’t at the very heart of democracy, I don’t know what is.

I sincerely hope that Judge Walker decides to televise the proceedings. Citizens have a right to see the workings of our courts, especially on constitutional matters like this. It is far more important—and a far better use of television’s power—than the endless criminal cases routinely broadcast on the various court television programs.

‘Hate’ Bill Signed October 28

October 29, 2009 – President Obama signed the “Hate” bill at a ceremony at the White House yesterday afternoon. The legislation, known as the Matthew Shepard Hate Crimes Prevention Act (S. 909), is based on false assumptions about the extent of “hate” directed against lesbian, gay, bisexual and transgendered (LGBT) people.

Senate Moves to ENDA Religious Freedom

November 2, 2009 – Senate Democrats don’t think they have created enough havoc so they have decided to hold a hearing on ENDA—S. 1584, the Employment Non-Discrimination Act.

Senate Health, Education, Labor and Pensions (HELP) Committee
will hold a hearing this Thursday, Nov 5 at 10:00am.

This legislation must be defeated. YOUR HELP IS NEEDED TODAY.

The Senate hearing is likely to be a rehash of what happened in the House on September 23 when House Democrats held a three-hour hearing on ENDA. The hearing was an orchestrated propaganda event promoting the gay lifestyle and Gender Identity Disorders.

The Employment Non-Discrimination Act (ENDA) is a pro-gay, pro-transgender bill that will be a nightmare for business owners, religious broadcasters and other Christian entities.

WHAT DOES SB 54 & SB 572 MEAN TO ME:

My precious brothers and sisters, please bear with me as I share my heart on this. In light of the Governors upcoming appointment of Lt. Governor, the passing of the Harvey Milk Bill and the homosexual marriage bill, and the hate crimes bill, I remind us of the following verses from Phillipians 4:6-9

SENATE BILL 572:  “HARVEY MILK DAY”

THE “HARVEY MILK DAY” BILL WOULD DO ALL OF THE FOLLOWING:

1. Forces every Governor to issue a proclamation declaring each May 22nd as “Harvey Milk Day”

2. Schools will be strongly “encouraged” to conduct “exercises” that celebrate and glorify the life and lifestyle of Harvey Milk.

3. Harvey Milk Day will result in schools telling students about homosexuality.

For every school that chooses to conduct “commemorative exercises” about Harvey Milk, they will be required by law to portray Milk’s homosexual lifestyle in a positive, “non-discriminatory” light. Given recently enacted Education provisions, SB 572 will result in every student in the state being given positive instruction about homosexuality and be taught about homosexual leaders in the homosexual movement in a positive manner. It is spelled out in black and white in the law.

4. Harvey Milk Day in schools will result in students discussing homosexuality and questioning sexual norms.

5. SB 572 overlooks the contributions of more well-deserving Californians, like Ronald Reagan, Richard Nixon, John Wayne, Sonny Bono, Clint Eastwood, Joe DiMaggio, George Lucas, Mark Spitz, Hiram Johnson, John Fremont, Walt Disney and more that warrant a day of “special significance,” long before Harvey Milk.


SENATE BILL 54: 
Undermines Prop 8 / Recognizes all Homosexual Marriages Performed Outside California

SENATE BILL 54 WOULD DO ALL OF THE FOLLOWING:

1. Force California to recognize any homosexual marriage performed outside of California that was performed before Proposition 8 was passed by voters on November 5, 2008.

2. Stretch the limits of the CA Supreme Court ruling and increase the number of homosexual marriages.

On May 26, 2009 the California Supreme Court ruled that Proposition 8 was a valid amendment to the state constitution to define marriage for one man and one woman. But they also ruled that those 18,000 homosexual marriages that were performed in California before November 5, 2008, the day in which voters passed Prop 8, shall be valid and intact. The court only allowed for only the 18,000 marriages here in California to be valid, none from other states. SB 54 would undo this ruling.

3. Give homosexual couples that are married outside of California legal footing to challenge in court Proposition 8’s validity and possibly have it overturned.
